SPONSOR AND OVERVIEW: The Jamieson Laboratories Ltd. “CANADA 150” Contest (“Contest”) starts on May 1, 2017 at 12:00 AM Eastern Time (“Contest Starting Date”) and closes on June 30, 2017 at 11:59 PM Eastern Time (“Contest Closing Date”) (comprehensively termed the “Contest Period”). The Contest is sponsored by JAMIESON LABORATORIES LTD. (“Jamieson” or “Sponsor”).
ELIGIBILITY: This Contest is open to all individuals who meet the below requirements, and individuals who enter in accordance with Paragraph 3 of these Official Rules (“Entrants”). To enter and be eligible to win the Contest, while supplies last, an Entrant:
Must be a legal resident of Canada as of the Contest Starting Date and continue to be a resident of Canada through at least the Contest Closing Date;
Must have reached the age of majority in his/her province of residence as of the Contest Starting Date;
Must not be an employee of, or a member of the immediate family of an employee of, or domiciled with an employee of, Jamieson Laboratories or VCCI, its subsidiaries, distributors, parent or affiliated companies, their respective advertising or promotional agencies, or the independent contest organization; and
Must provide proof of residence, identification, and age upon request. In these Contest Rules, “immediate family” means spouses, mothers, fathers, sisters, brothers, sons and daughters.
HOW TO ENTER: To enter and participate in the Contest, visit Jamieson’s Canada 150 website at www.JamiesonContest.com (“Website”), click on the “Enter” link, and complete and submit the online registration, including your full name, e-mail address, mailing address and UPC code from any participating Jamieson product. Please also confirm that you have read and agree to be bound by the Contest Rules, and indicate ‘yes’ or ‘no’ as to whether you wish to opt- in to receive additional information from the Sponsor. Enter as often as you wish online. To be eligible for the Grand Prizes, all online entries must be entered online on or before 11:59 p.m. on June 30, 2017 (“Contest Closing Date”).

If you do not have a valid Jamieson UPC code, you can obtain one by printing your name, e-mail address, mailing address and a telephone number clearly and legibly on a plain piece of paper, and describe in a minimum 50-word, handwritten essay what brand of vitamins you purchase and why. Mail it to: Jamieson "Canada 150" Contest, No Purchase Request, P.O. Box 157, Toronto Postal Station B, Toronto, ON, M5T 2T3. Limit of one (1) no purchase request per household during the Contest period. Duplicate essays or requests will be void and discarded. Assuming a legible, minimum 50-word, handwritten essay is received by Jamieson by June 21, 2017, you will be sent a valid UPC code via e-mail. Please also confirm that you have read and agree to be bound by the Contest Rules, and indicate ‘yes’ or ‘no’ as to whether you wish to opt-in to receive additional information from the Sponsor. Enter as often as you wish online. To be eligible for the Grand Prizes, all online entries must be entered online on or before 11:59 p.m. on June 30, 2017.
CONTEST GENERAL RULES: This Contest is subject to all applicable federal, provincial and municipal laws and/or regulations and every action taken by an Entrant in conjunction with the Contest must comply with these laws and regulations. This Contest is void where prohibited or restricted by law. By entering the Contest, Entrants agree to abide by these Official Rules and the decisions of the Sponsor, which are final.
Neither JAMIESON LABORATORIES nor their affiliates or representatives are responsible for lost, late, misdirected, incomplete, or non-delivered submissions; or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information.
By entering the Sweepstakes, Entrants agree to abide by these Contest Rules and the decisions of Jamieson, which are final.
GRAND PRIZE: There are three (3) Grand Prizes (“Grand Prizes”) available to be given away during the Contest Period, while supplies last, each consisting of a $4,000 CDN credit to be used towards any travel package through Travel Nation Canada.
CONTEST DRAWS: The potential winners of the Grand Prizes shall be selected by a random draw on July 6, 2017 (“Draw Date”) by Jamieson from a pool of eligible entries received by Jamieson during the Contest Period. Winners will be determined by random drawing from all eligible entries received by Sponsor. The odds of winning depends on the number of eligible entries received by Sponsor. The odds of an entry winning any Prize will be the same, whether the entry was automatically generated or made by alternate means of entry.
PRIZE AWARDING: The potential winner will be contacted after the Contest Closing Date in accordance with this section, and between the dates of July 6, 2017 and August 6, 2017, inclusively by email or telephone. A maximum of three (3) attempts will be made to contact the potential winner. If a voicemail is left for the potential winner, the potential winner must return the telephone call by 5:00 pm EST on August 11, 2017, in order to claim his/her potential Prize. If the potential winner fails to claim his or her Prize, there shall be a subsequent draw for another potential winner amongst all eligible entries.
Winners will be notified by email or phone within 15 days of the Draw Dates. Prizes will be awarded only on verification by Jamieson that all Contest requirements have been met by the winners. Each Prize must be accepted as awarded and no substitutions, transfers, conversions or assignments of Prizes will be allowed, unless at the discretion of the Sponsor which may substitute a Prize of comparable or greater value. Sponsor is not responsible for, nor shall they be liable for, late, lost, misdirected, or unsuccessful efforts to notify the winner. If a selected Entrant cannot be contacted within the allotted time, Sponsor reserves the right to void that entry and select another eligible Entrant for that Prize.
If the Winner dies during the payout period, and proof of death is provided by the estate of the deceased winner, then remaining payments shall be made to the estate of the deceased winner. Sponsor is not responsible or liable for late, lost, or misdirected communications from the Prize Provider to the official winners email address.
Each Grand Prize has a value of $4,000 CDN. All travel must take place within 12 months from the contest closing date. Prizes are non-transferable, cannot be redeemed for cash and will not be replaced if lost or stolen. Extensions to expiration dates will not be granted. Prize packages do not include travel to and from airports, meals or incidentals.
If you are notified by Sponsor that you are a potential winner of the Grand Prize, you will be required to first correctly answer a mathematical skill-testing question to be administered by phone or by mail, and to sign a Declaration and Release, before being declared an actual winner of the Grand Prize.
DISQUALIFICATION: Sponsor reserves the right in its sole discretion to disqualify any Entrant from participating in the Contest for any reason at any time throughout the Contest, including, but not limited to, violating these Official Rules or tampering with or abusing any aspect of this Contest or the operation of the Website or any other Sponsor-hosted website. In the event any portion of this Contest is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, which in its opinion, corrupts or impairs the administration, security, fairness or proper entry into the Contest, Sponsor reserves the right, in its sole discretion, to suspend or terminate the Contest and to award Prize(s) to individuals selected at random from the pool of Entrants received up to the point of termination. In no event will more Prizes be awarded than those listed in these Official Rules.
TAX INFORMATION: Liability for any applicable taxes imposed by any federal, provincial/state and/or local government, on any Prize won, is the sole responsibility of the winner of such Prize.
PRIZE DISCLAIMER: By participating in the Contest, Entrants agree that JAMIESON LABORATORIES and their affiliates and representatives, and their respective officers, directors, employees, representatives, and agents, will have no liability whatsoever for, and shall be held harmless by Entrants against, any liability for any injuries, losses or damages of any kind to persons, including personal injury or death, or property resulting in whole or in part, directly or indirectly, from participation in the Contest, or any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery. Entrants further agree that VCCI, JAMIESON LABORATORIES, their affiliates and representatives, and their respective officers, directors, employees, representatives, and agents, will not be responsible or liable for any injuries, damages, or losses of any kind, including direct, indirect, incidental, consequential, or punitive damages arising out of any of the submissions made by any Entry in the Contest, use of a Prize won in connection with the Contest or the failure by the Prize Provider to deliver the Prize to the winner in accordance with these Official Rules.
RELEASES: All final winners of any Grand Prize or Secondary Prize will be required to sign a Declaration of Compliance with the Contest Rules and a Publicity/Liability Release, confirming compliance with the Contest Rules, acceptance of the prize as awarded, releasing the Sponsor, its affiliates, subsidiaries, parent and related companies, advertising and promotional agencies, the independent contest organization and all of their respective directors, officers, owners, partners, employees, participating retailers, agents, servants, representatives, successors and assigns (collectively, the “Releasees”) from any actions, cause of action, suits, debts, claims, demands and liability whatsoever in connection with this Contest or the acceptance and/or use of any prize, including, without limitation, claims based on negligence, breach of contract and fundamental breach and liability for physical injury, death or property damaged which any entrant, his/her administrators, heirs, successors or assigns has or might have by reasons of, or arising out of, the entrant's participation in this Contest and/or in connection with the acceptance and/or use of a prize. Declaration and Release documents must be returned within ten (10) business days of the date of the notification and confirmation of prize winning. If the requisite documents are not returned within this 10-day period, then the prize may be forfeited at the discretion of the Sponsor. Only when all the documents have been completed by a potential winner and verified by the Sponsor will a potential winner be officially declared a winner and receive a prize. By entering the Contest and accepting a prize, the winners consent to the use of his/her name, address, voice, statement and photograph or other likeness, without further compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever including print, broadcast or via the Internet.
GENERAL: By entering the Contest, each entrant agrees to abide by the Contest Rules and the decisions of the independent contest organization, which shall be final and binding, without right of appeal, in respect to all matters related to this Contest, including, without limitation as to eligibility and/or disqualification of entries.
In the event it is determined that an entrant has entered in a manner that is not sanctioned by these Contest Rules, and/or has submitted more than the number of entries permitted by these Contest Rules, or has otherwise not complied with these Contest Rules, such entrant shall be disqualified.
All entries and requests for no purchase entries and Code Verification requests become the property of the Sponsor, which assumes no responsibility for incomplete, illegible, damaged, destroyed, lost, stolen, falsified, late, or misdirected or, insufficient postage entries or requests for entries, all of which shall be treated as void. Furthermore, the Sponsor shall not be responsible for problems, errors or negligence that may arise or occur in connection with the Contest, including, without limitation, inaccurate, or incomplete capture of entry information or any failure of the website during the promotional period, including, without limitation, as a consequence of any problems or technical malfunction of any kind including, without limitation, in respect to computer equipment, hardware, software, human or technical errors, printing errors, lost, deleted, failed, incomplete or garbled date, communications or transmission interruptions, deletions, defects or failure of any telephone or computer lines or networks, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including, without limitation, any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion, or errors in advertising, the selection and announcement of winners and/or the awarding of any of the prizes.
The Sponsor reserves the right, in its sole discretion, to cancel or suspend this Contest should a virus, bug or other cause, beyond the reasonable control of the Sponsor, corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, irregular, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way or that have been submitted through illicit means or do not conform with or satisfy any or all conditions of these Contest Rules.
In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be deemed to be made by the authorized account holder of the email address at the time of entry. Authorized account holder is the natural person who was assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain name associated with the submitted email address.
All entries, and requests for no purchase entries, become the property of the Sponsor and none will be returned. No communication will be entered into except with a potential winner.
Any litigation respecting the conduct or the organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement.

Personal information is any information about an identifiable individual, such as Your name, email address, mailing addresses, gender, date of birth, any answers and data You elect to provide to questionnaires, information collected electronically through Jamieson's web site located at www.jamiesonvitamins.com or other web site(s) operated by Jamieson time to time (each a "Jamieson Site"), and any other information that identifies who You are. Personal information about You may be collected by Jamieson directly or provided to Jamieson by third parties.
What Personal Information does Jamieson Collect?
Jamieson limits the collection and use of Your information to that which is necessary to fulfil identified purposes or to deliver requested information, products or services to You.

The information we ask for will depend on the information or service requested. Different information and services require different types of information. Your information may be collected via an "active information collection point" or through passive means.

Uses and Disclosure of Information
Except as described in this Policy or as You may otherwise consent to from time to time, Jamieson will not use, and will not disclose or provide any of Your personal information to any other person. When You provide information to Jamieson by completing a registration form, submitting questions or comments or feedback concerning Jamieson or products and services and other topics, completing surveys and evaluations and other similar situations, we will use this information to learn more about our customers and their preferences, improve our products, services and the Jamieson Sites and for related marketing and research purposes.
Jamieson reserves the right to transfer any information submitted by You and retained by Jamieson to Jamieson affiliates to the extent necessary to perform requested services and provide requested information. Jamieson may sell all or part of its business, sell or securitize assets, or merge or amalgamate part or all of our business with other entities. Since customer information and data would normally be a part of such transactions, we may use or disclose such information to other parties included in the transaction, as part of due diligence activities and/or on the completion of the transaction.
Jamieson does not knowingly collect personal information from children under the age of 18, except for the purpose of voluntary requests for product recommendations, made on behalf of the child by his or her parent or guardian, and only upon securing the informed consent of the parent or guardian to Jamieson’s collection of that information insofar as is necessary for the purpose of providing product recommendations. Exceptions where Jamieson may Collect, Use or Disclose Information without Consent
If we are required or permitted by law: We may be required to release information by a court of law or other legal or regulatory authority. If so, our policy is to release information only to the extent that we have to. We may also collect, use or disclose information without consent where permitted by law. For example, we may collect and use publicly available information like information in the telephone book for marketing or customer service purposes. Further, for other legal, medical, emergency or other security reasons, it may be impossible or impractical to seek or obtain Your consent.
If we use an outside third party supplier to do work for us: We may from time to time use outside third party suppliers to do work for us involving some of Your information. For example, to perform computer services on our behalf or to analyze survey results or marketing data or to administer to manage promotions or contests or for other reasonable purposes. We select the company carefully and confirm that it uses privacy and security standards that meet Jamieson's requirements.
If we have to protect the interests of Jamieson: In certain circumstances, Jamieson may have to collect, use or release information without consent for its protection. For example, we may do so to detect, investigate or prevent fraud.
Rights to Provide Information
With respect to all content and information You submit to Jamieson, including by submitting or posting to the Jamieson Site, in providing us with such content and information we rely on You to ensure that You have the lawful right to do so without limitation or restriction.
Jamieson may collect aggregated, anonymous information (such as demographic and profile data, usage and selection data and similar information and data) about You, including in connection with Your use of a Jamieson Site, Your participation in various Jamieson promotions or contests and otherwise in connection with the purchase of Jamieson products and use share that information with other third parties (such as Jamieson's service providers, agents, marketing consultants and advertisers) in order to better understand and learn more about our customers and their preferences, improve our products, services and the Jamieson Sites and for related marketing and research purposes. Any such aggregated information will not contain personally identifiable information about You.
Jamieson will keep Your information only for as long as it is reasonably needed to fulfill the purposes for which it was collected, unless and to the extent a longer retention is permitted or required by law. Jamieson has also developed a retention and destruction timetable to ensure that Your information is not retained for a longer period of time than is necessary for its intended purpose. We destroy, erase, or aggregate and render anonymous information that is no longer required, and ensure that all personal information is fully deleted before disposing of electronic devices such as computers, photocopiers, and cell phones. Jamieson regularly conducts risk assessments, and has developed, documented, and implemented breach and incident management protocols, appropriate service provider management practices, and appropriate privacy training to employees.
The length of time we keep Your information varies depending on the reason it was collected and the nature of the personal information. For legal reasons, we may keep information beyond the end of Your relationship with us.
Accuracy & Access to Your Information
You have the right to access, verify, rectify and update Your personal information. Jamieson has developed and implemented policies and procedures to respond to access requests, as well as inquiries and complaints. All such requests may be directed to the privacy officer, whose contact information can be found at the bottom of this page.
Jamieson takes reasonable steps to ensure Your personal information is accurate, complete, and up-to-date. However, in certain circumstances, we must rely upon You to advise us if Your personal information changes. If You notify us that Your personal information is inaccurate or incomplete, we will take steps to correct, delete, or add to it, as appropriate.
You can contact Jamieson to request to know what information Jamieson may have collected and retained about You and how that information is being used. In submitting your request, we ask that you supply enough information to account for the existence, use, and disclosure of Your information. Should you require assistance in preparing your request for access to personal information, Jamieson’s Privacy Officer will be available to assist you. We will endeavour to respond to your request as soon as possible, and within thirty (30) days of receipt of said request. Depending on the nature of the information You are requesting and complexity of Your request, we may ask You to put Your request in writing. In some instances on, You may be able to log into Your account profile or preferences on a Jamieson Site to view and/or modify Your information, as appropriate.
We protect other people's privacy when we make information about You available to You. It may not be appropriate for us to release certain information directly to You. There may be records that include information about You and other customers, or that have information confidential to Jamieson or are the property of Jamieson. Because we must protect everyone's confidentiality and legal rights, we cannot make these records available to persons outside of Jamieson. We will, however, make available to You any factual information about You contained in such records. If we are unable to disclose information to You, we'll explain why, subject to any legal restrictions. If You wish to challenge our decision, we will tell You how to escalate Your request.
You Can Withdraw Your Consent
Subject to legal and contractual requirements, You may change or withdraw Your consent at any time (which includes electing not to receive further communications or other services from us) by: (1) changing Your choice on the Jamieson Site, if and where available; (2) using the unsubscribe feature, in the case of e-mail distributions if and where available; or (3) contacting Jamieson's Consumer Affairs Department in the "Contacting Jamieson" section of this Policy below. You may also withdraw Your consent at any time by contacting the relevant privacy officer, whose information is listed at the bottom of this page.
Withdrawing Your consent will generally not affect Your relationship with Jamieson or eligibility to receive Jamieson offers. However, if You don't consent or if You withdraw Your consent, we may not be able to provide You with a particular service or provide You with requested information. When You change or withdraw Your consent, we will do our best to make sure that our files are updated as quickly as possible. It may take some time for our records to reflect Your changes as many records can only be changed during regular file updates.
Safeguards and Security
We will use reasonable efforts to protect information that You provide to Jamieson once it has been received by Jamieson. Jamieson employs physical, administrative and technical safeguards, reasonably appropriate to the sensitivity of the information, to safeguard Your personal information against loss, theft, misuse, unauthorized access or disclosure and alteration.
For example, with respect to Jamieson Sites, Jamieson uses SSL (Secure Socket Layer) technology, an encryption technology used to encrypt information sent from Your computer to our servers over the Internet. Unfortunately, no data transmission over the Internet or system can be guaranteed to be 100% secure.
Although Jamieson uses reasonable efforts to safeguard Your information, we cannot guarantee it. Jamieson cannot ensure or guarantee that any information You provide to Jamieson is completely secure from individuals who might attempt to deliberately evade security measures, including by intercepting transmissions over the Internet. You provide Jamieson with Your information at Your own risk.
Confidentiality of Supplied Information
In order to protect the security and confidentiality of any personally identifiable information supplied by You to Jamieson (such as web site passwords and similar information relating to or concerning You) You are responsible to ensure all such information is kept confidential and secure by You.
If, at any time, You wish to make a complaint about Jamieson’s privacy policies or use of Your information, You may do so by contacting the individual listed at the bottom of this page, who will inform You of Your avenues of recourse and the available complaint procedures. Jamieson will acknowledge and investigate all complaints received, record the date the complaint was received and its nature, and assign the task to an individual for an impartial review. We will notify You of the outcome of Your complaint, and take appropriate measures to correct information handling practices.
